Terms of use
The terms for using JoaoGym, as a coach, a gym or a client.
This is a draft. It has not yet been reviewed by a lawyer, and JoaoGym does not hold any real client's information yet. It describes how the service is built to work.
What JoaoGym is
JoaoGym is a tool for recording personal training: programs, sessions and progress. It is provided to gyms, who make it available to their coaches. Clients do not need an account. A client who asks for summaries by email can open their own pages through the links in those emails.
By using JoaoGym you agree to these terms. If you do not agree, please do not use it.
Not medical advice
JoaoGym records what a coach and a client decide to do. It does not diagnose injuries, prescribe treatment or rehabilitation, or judge whether an exercise is safe for a particular person. Those decisions belong to the coach and the client, and to a medical professional where one is needed. Nothing shown in JoaoGym is medical advice.
If you are a coach
- Your account is yours alone. Keep your password and PIN to yourself, and sign out or hand the iPad back to the PIN screen when you step away.
- Open a client's records only when you need to for their training.
- Let clients answer the consent questions themselves. Do not answer for them.
- Use a nickname for each client, and keep injury details to the watch-outs, where the client has agreed to them. Do not put health information, or anything about other people, in other notes.
- Do not add anyone under 18.
- Tell your gym at once if you think someone else has used your account, or if a gym iPad is lost.
If you are a client
- The links in your emails open your own pages without a password. Keep those emails to yourself.
- You can stop the emails at any time from the link in any of them.
- How your information is handled is set out in the privacy policy.
Acceptable use
You must not:
- try to reach information you are not entitled to see;
- interfere with the service, test it for weaknesses without permission, or get around its security;
- copy information out of JoaoGym for any purpose other than the client's training;
- use the service for anything unlawful.
Your information
The records a gym and its coaches put into JoaoGym belong to the gym and, where they are about a client, are that client's personal information. JoaoGym uses them only to provide the service, as described in the privacy policy and in its agreement with the gym.
Availability and changes
JoaoGym is under active development. Features may change, and the service may occasionally be unavailable, for maintenance or for reasons outside our control. It needs an internet connection to work. A coach should always be able to run a session without it.
Responsibility
The service is provided as it is. As far as the law allows, JoaoGym is not responsible for injury, loss or damage arising from training decisions, from records that were entered wrongly, or from the service being unavailable. Nothing in these terms limits any liability that cannot be limited by law, or any rights you have as a consumer.
Ending use
A gym can stop using JoaoGym, and can remove a coach's access, at any time. Access may be suspended for a serious or repeated breach of these terms. What happens to a gym's records when it leaves is set out in its agreement with JoaoGym.
Law
These terms are governed by the law of Ireland, and the Irish courts deal with any dispute about them.
Changes to these terms
If these terms change in a way that matters, the date at the top changes and gyms are told before the change takes effect.
